How threatening is the U.S. Constitution?

When a marriage goes south, the partners don’t amend the marriage vows to keep the vows compliant with issues of infidelity.

Likewise, when the federal government violates their Oath, we must not change the words in the constitution to justify federal non-compliance.  Enforce the 10th Amendment first, and then see what America looks like.

HB 98 (Flynn) COULD BE the best 1st step for Texas to ENFORCE the 10th Amendment.  However the bill will die on Thursday if the House Calendar committee keeps the bill in lockdown.

One presumes the committee must support some other constitution sitting on a shelf somewhere because it has approved three (3) bills to change our current constitution to comply with a federal tyrant  (HB 1110, HJR 79, & HJR 77), but the committee has failed to support the 10th Amendment.

JOINT LEGISLATIVE COMMITTEE on CONSTITUTIONAL POWERS AND ENFORCEMENT
To Interpose UN-Constitutional Federal Actions

Forming a Joint Legislative Committee on Constitutional Powers and Enforcement…
14 Members:

  • 7 appointed by Speaker of the House
  • 7 appointed by the Lt. Governor
  • Not more than 4 members from each chamber may be of the same political party
  • Two year terms
  • Speaker and Lt. Governor each appoint one Joint Chair

Duties of Joint Legislative committee…

  • Committee shall meet at the call of either committee chairman
  • Simple majority constitutes a quorum
  • Simple majority rule for votes
  • Committee shall vote within 180 days after hearing
    Committee shall report to the Governor & Attorney General each federal action determined to be unconstitutional action, and may include one or more effective and constitutional ways to prevent the application of the federal action in Texas
  • Committee shall submit report to Speaker & Lt. Governor before Dec. 1st of even-numbered year, each unconstitutional federal action since the previous report, and to include recommendations for effective and constitutional legislative responses
  • Attorney General may represent the state or political subdivision to interpose between state or subdivisions and federal government in unconstitutional federal acts
  • Speaker & Lt. Governor shall appoint the Joint Legislative Committee on Constitutional Powers and Enforcement not later than the 30th day following the effective date of HB 98

The Remedy to a Rogue Federal Government is in the U.S. Constitution

The first 5 words in Article I of the U.S. Constitution make it abundantly clear that the states created and grant the duties and powers to the federal government: “All legislative powers herein granted…”, and it is the state responsibility to enforce the U.S. Constitution.

Article VI of the U.S. Constitution is clear.  Any laws made contrary to the U.S. Constitution are void;

This Constitution, and the laws of the United States which shall be made in pursuance thereof; and all treaties made, or which shall be made, under the authority of the United States, shall be the supreme law of the land; and the judges in every state shall be bound thereby, anything in the Constitution or laws of any State to the contrary notwithstanding.

The People and the States clearly retained all power not delegated to the federal government as listed in the U.S. Constitution; the 9th and 10th Amendments:

The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.” And “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

ENFORCE the U.S. Constitution. Don’t amend the constitution.

    Thanks too for your list of Calendars committee members. Now if I had a calendar of their townhall meetings I’d make every attempt to attend.
